These Terms govern your access to and use of CAACS. We've kept the "short version" above for the key points — read on for the full detail.
1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of CAACS (the "Service"), operated by CAACS ("we," "us," "our"). By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms on behalf of yourself and the organization you represent. If you don't agree, don't use the Service.
2. The Service
CAACS is a multi-tenant platform that lets organizations record or upload sales and support calls, automatically transcribes and audits them using AI, scores them against configurable criteria, flags risk, and surfaces coaching recommendations. Each organization's data is logically isolated from every other organization using the Service.
3. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to create an account. The person signing up represents that they are authorized to bind their organization to these Terms. You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Each organization's Admin is responsible for managing the Agent accounts they create within the Service.
4. Free trial
New organizations may start a free trial, time-boxed and call-count-boxed as shown at signup, with no payment details required. We may change the trial's length or call limit at any time for new signups. We reserve the right to suspend or permanently delete a trial organization's account and data at our discretion, particularly where a trial account is abandoned or never converts to a paid subscription — see our Privacy Policy for how this interacts with data retention.
5. Subscriptions and billing
Paid subscriptions are billed per seat (licensed Admin/Agent account), monthly or yearly as selected at checkout, and are processed through our payment provider, Razorpay. By subscribing, you authorize us to charge your chosen payment method for the applicable fees.
- Renewal. Subscriptions extend your access through the end of the purchased term; renewing before expiry extends your existing term rather than restarting it.
- Price changes. We may change plan pricing for future purchases; changes do not retroactively affect a term you've already paid for.
- Custom plans. A negotiated Custom plan is billed and documented separately as agreed between you and us.
- Cancellation. You may stop using the Service at any time, with no notice period and no lock-in. Each payment is a one-time purchase of a fixed term (not a recurring auto-charge), so there's nothing to actively "cancel" — your organization simply keeps full access through the end of whatever term you've already paid for, and access ends only if you choose not to renew. Stopping use early, or choosing not to renew, does not entitle you to a refund for the remaining, unused portion of a paid term.
- Refunds. Beyond the above, fees are generally non-refundable except where required by law or expressly agreed by us in writing.
- Non-payment. If a subscription isn't renewed, your organization's access is restricted until renewal; we do not delete your data solely for non-payment within the retention periods described in our Privacy Policy.
6. Your Content
"Your Content" means call recordings, transcripts, scores, and any other data your organization submits to or generates within the Service. As between you and us, you own Your Content. You grant us only the limited right to host, process, and display Your Content as needed to provide the Service to your organization — see our Privacy Policy for the full detail on how Your Content is handled.
You are responsible for Your Content and for having the rights necessary to submit it to the Service, including any consents described below.
7. Acceptable use & call recording consent
You agree not to use the Service to violate any applicable law, infringe anyone's rights, upload malicious code, attempt to access another organization's data, or reverse-engineer the Service.
8. Our intellectual property
The Service itself — its software, design, scoring methodology, and branding — is owned by us and protected by intellectual property law. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for your organization's own internal purposes; they don't grant you any ownership in the Service.
9. Disclaimer of warranties
The Service, including any AI-generated scores, summaries, or coaching recommendations, is provided "as is" without warranties of any kind, express or implied. AI-generated output is probabilistic and may contain errors or omissions; it is a decision-support tool, not a guarantee of accuracy, and should not be the sole basis for any compliance, employment, or legal decision.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim arose.
11. Indemnification
You agree to indemnify and hold us harmless from any claim arising out of Your Content, your use of the Service in violation of these Terms, or your failure to obtain required call-recording consents.
12. Termination
You may stop using the Service, or request account deletion, at any time by contacting support@caacsglobal.com. We may suspend or terminate an account that violates these Terms, poses a security risk, or (for trial accounts) has been abandoned. Sections that by their nature should survive termination (ownership, warranty disclaimers, liability limits, indemnification, governing law) will survive.
13. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in India.
14. General provisions
- Severability. If any provision of these Terms is found unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- Force majeure. We will not be liable for any failure or delay in performing the Service to the extent caused by circumstances beyond our reasonable control, including natural disasters, acts of government, internet or power outages, or failures of third-party service providers we rely on.
- Assignment. You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, without your consent.
- Entire agreement. These Terms, together with our Privacy Policy and any order form or plan terms agreed between you and us, constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements or understandings on this subject.
- Notices. We may provide notices to you by email to your registered account address or by posting within the Service. Notices to us should be sent to support@caacsglobal.com.
15. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, notify your organization's administrators directly. Continued use of the Service after a change takes effect means you accept the updated Terms.
